Terms of service

These terms are the agreement between you and RailBuddy for your use of Rail Buddy. By signing in or using the service, you accept them.

Rail Buddy is not a safeworking system

Rail Buddy is a situational-awareness aid. It does not authorise movements, does not replace signals, the train control network or your route knowledge, and must never be used as a source of safeworking instruction.

Always follow your operator's rules and the signals in front of you. If Rail Buddy and the signal disagree, the signal is right. It is not affiliated with, endorsed by or operated by any rail operator, network manager or rail safety regulator.

What the service is

Rail Buddy shows a live view of the road ahead — gradients, curves, km posts, crossings and crew-built landmarks — positioned along the corridor as you travel, plus a planner for reviewing a route beforehand.

Content you create

You keep ownership of the pins, segments and notes you add. By putting content on a shared public layer you grant us and other users of that layer the right to display and use it within the service. Content on a shared layer may be retained after your account closes, because other crews depend on it.

Do not add anything misleading, offensive, or capable of being mistaken for a signal, sign or safeworking instruction. We may remove content that breaches this.

Accuracy and availability

Rail network geometry, landmarks and elevation come from imported datasets and from crew-entered content. They may be out of date, incomplete or wrong, and the physical road changes. Position depends on your device's own location, which can drift, lag or fail entirely — particularly in cuttings, tunnels and long sections without signal.

We aim to keep the service available but do not guarantee uninterrupted access, and it will not work without network coverage. Never build a plan that depends on Rail Buddy being available or correct.

Intellectual property

We own the service — its software, design, and the way we compile and present information. You get a personal, non-exclusive, non-transferable right to use it under these terms, and nothing more. Underlying public datasets remain the property of their source and are subject to their terms.

Your rights under Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees. For a major failure you are entitled to cancel and to compensation for any other reasonably foreseeable loss or damage.

Where we are permitted to limit our liability, we limit it to resupplying the service or paying the cost of resupply.

Limitation of liability

Subject to the section above, and to the maximum extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from your reliance on the road view, a landmark, a gradient or a position fix, or from the service being unavailable.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud.

Suspension and termination

Your administrator can close your account at any time. We may suspend or terminate an account that breaches these terms, or where we are required to by law.

Changes to these terms

We may update these terms. The "last updated" date above reflects the current version, and we will give notice in the app of a change that materially disadvantages you. Continuing to use the service after a change takes effect is acceptance of it.

Governing law

These terms are governed by the law of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts able to hear appeals from them.
